Gambar berikut saya rakam pada jam 5.32 petang Rabu, 13 Julai 2016, di simpang empat, Jalan Batu Uban-Jalan Sungai Dua-Lebuh Sultan Azlan Shah, Sungai Dua, Pulau Pinang:
Semasa saya mengambil gambar-gambar ini, perkara-perkara berikut bermain di fikiran saya...
1. Eh, sempat pula dia ni menciluk diantara beberapa kenderaan, termasuk kenderaan saya, dengan barangan niagaanya (roti dan lain-lain) "melibas" dinding-dinding kenderaan-kenderaan;
2. Eh, mana nombor pendaftaran motosikalnya?
3. Eh, tak jatuh ker, barangan yang dibawa tu?
4. Barangan yang "bersidaian" tu, tak mengganggu perjalanannya ker?
5. Macam mana jika dia di jalan lurus, dan kenderaan lain, terutama motorsikal, ingin memotongnya?
6. Bagaimana dia nak memberi isyarat untuk membelok (ke kiri atau ke kanan)?
Semua soalan di atas menjurus kepada SATU TOPIK UTAMA, iaitu KESELAMATAN DI JALANRAYA.
Mungkin ini jawapan dan prinsip yang penunggang motosikal (penjual roti?) tersebut pegang:
1. Encik..kalu bawa dalam tong (kotak) sahaja, ia sikit... Mana saya mau cari makan?
2. Ah...dah berzaman saya buat kerja macam ni..Taka aa masaalah pun...
3. Siapa mau saman? Mereka kesian sama saya...
4. Tak tau la pulak, muatan ini "mengganggu" orang lain
5. Saya selesa macam ini
6. Ini keslahan kecil saja...no hal la....
7. Ada saya kesah!!!!
Dari aspek undang-undang dan prinsip yang tegas, mungkin peruntukan-peruntukan berikut, relevan:
1. Rule 16, Road Traffic Rules, 1959 (Obstruction).
(1) No driver in charge of a vehicle shall
cause or permit the vehicle on a road so as to cause any unnecessary
obstruction thereof;
2. Rule 17, Road Traffic Rules, 1959 (Driver to have proper control of vehicle).
No driver while actually driving a vehicle
shall be in such a position that he cannot have proper control over the
vehicle or that he cannot retain a full view of the road and traffic
ahead or that he cannot by means of hand signals or direction indicators
give signals to traffic to the rear of the vehicle;
3. Rule 20, Road Traffic Rules, 1959 (Use of suitable vehicle).
No vehicle shall be used for any purpose for
which it is so unsuitable as to cause or be likely to cause danger to
any person on the vehicle or on a road;
4. Rule 21, Road Traffic Rules, 1959 (Load projecting beyond the rear, front or side).
No motor vehicle shall carry any load that
projects beyond the rear, front or side of the body of the vehicle
unless prior approval as been obtained from the Director General on the
ground that on a certain route that the owner of the vehicle wishes to
operate it is suitable in the circumstances to do so;
5. Rule 50, Road Traffic Rules, 1959 (Prohibition of obstruction).
No person, article, goods or materials shall
remain on any public road or footpath so as to obstruct or prevent the
free passage of traffic or pedestrians;
6. Section 14, Road Transport Act 1987 (Display of registration number).
(1)
The registration number assigned to a motor vehicle
upon registration or a new registration number assigned under section 11
shall be displayed and illuminated on the number plate in
the manner prescribed by rules made under this Act.
(4)
If a registration number is not displayed in accordance with this
section, the driver or person in charge of the vehicle while it is
being used shall be guilty of an offence and shall on conviction be
liable to a fine of not less than three hundred ringgit and not more
three thousand ringgit.
Q: PRINSIP MANA YANG PALING SESUAI DIGUNAKAN SECARA MUNASABAH DAN ADIL?
